Under the new Consumer Protection Law, a timeshare contract is a contract for more than a year under which a consumer pays for the right to accommodation over several periods of use, and a long-term holiday product contract (holiday club) is a contract for more than a year giving the right to accommodation discounts. The consumer may withdraw from such a contract without giving reasons within 14 days, and the period extends to one year and 14 days if they did not receive the withdrawal form. Until the withdrawal period ends, the trader may not ask for an advance payment, a guarantee, a reservation of funds on an account or an acknowledgement of debt. A timeshare or holiday club may not be offered as an investment. The contract is made in writing, in Montenegrin or in the language of the consumer's country, as the consumer chooses.

Which contracts does the law cover?

- Any clause on tacit renewal or extension counts towards the length of the contract.
What must the trader do?
- State in the advert where the pre-contractual information can be obtained.
- Clearly state the commercial purpose in the invitation to a promotional or sales event.
- Before the contract becomes binding, hand over the information free of charge on a standard form, in writing or on a durable medium.
- Make the contract in writing, with a withdrawal form, and give the consumer two copies.
- For a timeshare linked to a property, provide a certified translation of the contract into Montenegrin or the language of the country where the property is.
- Warn the consumer of the right to withdraw, the period and the ban on advance payments; the consumer signs these clauses separately.
How do you withdraw from the contract?
- The period is 14 days from signing the contract or binding preliminary contract, or from receiving a copy if that is later.
- If the trader did not provide the withdrawal form, the period ends one year and 14 days later.
- If the trader did not provide the information on the standard form, the period ends three months and 14 days later.
- The withdrawal is sent to the trader in writing or on a durable medium, possibly on the standard form; it is enough that the notice is sent before the period ends.
- The consumer pays no costs and nothing for services used before withdrawal, and is not liable for any loss to the trader.
- Withdrawal also ends any linked exchange contract or credit used for payment, at no cost to the consumer; money paid under an ancillary contract is refunded within 30 days.
How is a holiday club paid for?
- Only under the instalment plan in the contract, in equal annual instalments, including the membership fee.
- The trader sends a written payment request for each instalment at least 14 days before it falls due.
- After the second instalment the consumer may cancel without compensation or penalty, within 14 days of receiving a payment request.
- In a resale, the trader may not ask for money until the right is resold or the contract ends.
