Under the new General Product Safety Law, applicable from 30 June 2026, a supplier that recalls a product for safety reasons must offer the consumer a choice of at least two remedies: repair, replacement with a safe product of the same type and at least the same value, or a refund of no less than the price paid. If repair or replacement does not follow within a reasonable time, the buyer is entitled to a refund. The consumer pays no shipping or return costs, and a product that cannot be sent by post is collected by the supplier at its own cost. The recall notice is headed "Product safety recall" and must be in Montenegrin. The law applies to products on the market whether they are new, used, repaired or reconditioned.

What must a recall notice contain?

- The supplier notifies directly all consumers it can identify; it may use buyers' personal data only for the recall and safety warning.
- When it cannot contact all buyers, it publishes a visible notice, for example on its website, social media and at points of sale.
Which remedies does the buyer have?
- Repair of the recalled product.
- Replacement with a safe product of the same type and at least the same value and quality.
- Refund of the product's value, at least the price paid.
- The supplier may offer only one remedy only if another would be impossible or disproportionately costly.
- A repair carried out by the buyer counts only if it is simple and safe and provided for in the notice, with free instructions, spare parts or software updates.
- A recall does not reduce the buyer's rights under the Consumer Protection Law for goods that do not conform.
What must online marketplaces do?
- Let sellers state, for each product, the manufacturer and contact address, the product's picture and identifier and warnings in Montenegrin.
- Notify directly buyers who bought a recalled product through them and publish recall information.
- Suspend traders who frequently offer non-compliant products, after a prior warning and under rules set out in their terms of service.
- Cooperate with inspectorates and remove offers of dangerous products.
